The following Terms of Use apply to ALL Hostshabhji customers:
Hostshabhji services may be used for lawful purposes only. Transmission, storage or distribution of any information, data or material in violation of any applicable law or regulation or that may directly facilitate the violation of any particular law or regulation is prohibited. This includes, but is not limited to: copyrighted material; trademarks; trade secrets or other intellectual property rights used without proper authorization; material that is obscene, defamatory, constitutes an illegal threat, or violates export control laws.
Sending unsolicited bulk and/or commercial messages over the Internet (known as "spamming") is prohibited, regardless of whether or not it overloads a server or disrupts service to Hostshabhji's customers. Hostshabhji reserves the right to determine, in its sole and absolute discretion, what constitutes a violation of this provision.
Violations of system or network security are prohibited and may result in criminal and civil liability. Examples of system or network security violations include, without limitation the following: unauthorized access to or use of data, systems or networks; interference with service to any user, host or network including, without limitation, mail bombing, flooding, deliberate attempts to overload a system and broadcast attacks; forging of any TCP-IP packet header or any part of the header information in an email or a newsgroup posting.
Use of Hostshabhji's services or equipment for creating or sending Internet viruses, worms or Trojan horses, or for pinging, flooding or mail bombing, or engaging in denial of service attacks is prohibited.
The use of Hostshabhji's services to store, post, display, transmit, advertise or otherwise make available any type of pornography is prohibited. Hostshabhji as required by law, and will, notify law enforcement agencies when it becomes aware of the presence of pornography on, or being transmitted through its services.
Hostshabhji reserves the right to suspend the services if the payments are not made by the due date. Hostshabhji shall not be held liable for any kind of loss due to disruption of services. We are not resposnsible for any kind of data loss if payment not made on time.
Refunds are available on our Shared hosting for 30 days, there is no refund for our dedicated servers and vps and any third party software, scripts like cPanel, Cloudlinux, Litespeed etc. if your account is suspended or terminated by violating our terms no refunds will be provided.
The failure by a customer to meet or follow any of the TOU is grounds for account deactivation. Hostshabhji will be the sole arbiter as to what constitutes a violation of the TOU. Hostshabhji reserves the right to remove any account without prior notice and to refuse service to anyone at any time. Depending on the severity of the violation, Hostshabhji may, at its sole discretion, restrict, suspend or terminate a customer's web hosting account and/or pursue other civil remedies. If such violation is a criminal offense, Hostshabhji will notify the appropriate law enforcement authorities of such violation. Hostshabhji does not issue credits for outages incurred through service disablement resulting from TOU violations. Hostshabhji customers agree to indemnify and hold harmless Hostshabhji from any claims resulting from the use of our services that damages them or any other party.
Hostshabhji does not allow IRC or IRC bots to be operated by Web Hosting and E-Commerce customers.
Hostshabhji's Web Hosting and E-Commerce accounts should not be used to distribute illegal or pirated software and/or multimedia products.
The Hostshabhji service is provided on an as is, as available basis without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose or non-infringement. Hostshabhji and its partners and suppliers will not be liable for any cost or damage arising either directly or indirectly from any transaction or use of the service.
Hostshabhji strictly prohibits its Partners from publicly disclosing their own earnings because no one person’s income is typical but does show what is possible with time, effort, and dedication.
What you earn as an Hostshabhji partners is wholly determined by your own individual efforts. Hostshabhji does not guarantee that any partners will earn any amount of income or any income at all from the promotion of our program.
The amount of time and/or money you invest in your business, will determine your success.
